THE OPINION AND VERDICTS OF COURTS ABOUT QADIYANIAT

 

Federal Sharia't Court of Pakistan

     In a 222 page verdict, the Federal Sharia't Court rejected an application filed by the Qadiyanis and declared that Qadiyani Ordinance is in no way contrary to the Quran and Sunnah. Some Qadiyanis appealed to the Federal Sharia't Court that some of the articles of Ordinance dated 1984 concerning the anti Islamic activities and speeches of the Ahmadis, the Qadiyani group and the Lahori group, should be declared as contrary to Quran and Sunnah. The court heard to the appeal in detail.

    The questions raised in the court was whether the prophet hood after Hazrat Muhammad (Sallallaho Alaihe Wassallam) was continuing. Whether he was Khatam un Nabiyyeen (the last of the prophets) and no prophet would come after him, ever. After hearing the explanation from Quran and Sunnah and the opinion of both the Shia and Sunny scholars, the court gave the verdict that the prophet hood has ended and the Holy Prophet Muhammad (Sallallaho Alaihe Wassallam) was the last of the prophets.

    The court also concluded that the Christ would reappear as a “follower” of Islamic Sharia't (law) and that Mirza Qadiyani was neither the Promised Christ nor a Mehdi. In addition, the people who give false meaning to the verses of Quran are not Muslims and Mirza Ghulam Ahmed, who called himself a prophet, was Kaafir (infidel).

    Mirza Ghulam Ahmed’s life reveals that he was wicked and a cheater who tried to prove himself first a ‘Muhaddith’ (innovator), then a ‘Zilly’ and a ‘Bruzi’ (shadow) prophet and not only a prophet but also the Christ and ultimately God. All his foretelling and revelations proved to be false and to escape being laughed upon, he tried to prove them by giving lame interpretations of his own writings, including that he had never claimed prophet hood. Mirza Ghulam Ahmed himself claimed that God hat sent revelations unto him and that whoever did not accept him as a prophet after the message had reached him was Kaafir (infidel). Chaudhry Zaffarullah Khan supported this claim who refused to participate in the funeral prayers of Quaid-e-Azam. The followers of Mirza Qadiyani did not allow the Muslims to say ‘Azan’ in Qadiyan.

    The court reached the conclusion that by not allowing them to use Islamic signs and terminologies, it did not mean that the state was interfering in their rights of worship. They can do so if they do not reveal themselves as Muslims. Also they will not be allowed to preach their faith and exaggerate about their faith.

    The Qadiyanis will not use words like ‘Ummul Momineen’, ‘Ameerul Momineen’, and ‘Khalifatul Momineen’ because these words will mislead the Muslims. The same was the decision about the words used for the companions and the family of the Holy Prophet (Sallallaho Alaihe Wassallam).

    Muslims do feel hurt when Qadiyanis represent themselves as Muslims, act like them or use their names and titles. These things created the situation of law and order. So the court gave its verdict that punishment and fine that was imposed in the Ordinance of 1984 on using the Muslim terms and names by the Qadiyanis was a just law.”

 

Justice Malik Ghulam Ali

 “Qadiyaniat is an explosive mine spread under (Islam’s) walls by anti- Islam forces”.

 

Justice Khaleel ur Rehman

    On 23 March 1989, the Qadiyani Jama'at became 100 years old. Government banned their hundred year’s celebrations. While rejecting a writ against this ban Justice Khaleel ur Rehman agreed with the state and people’s lawyers and wrote:

 “ Qadiyanis have the right not only to lead their life according to their faith but they have complete liberty like other minorities – Hindus, Sikhs, Parsees etc. But the Qadiyanis themselves have created problems for themselves by declaring themselves as Muslims, by adopting ‘Kalema Tayyeba’ and the other Islamic rituals. These are the basis of Islam. If the Qadiyanis lead their lives according to the law prescribed for them and consider themselves as a separate group from the Muslims, there will be nothing wrong in it. Their loyalty to the constitution and their status as a separate class will ensure their security and progress. How can they be allowed to pollute Muslims’ faith? If Muslims do something to safeguard their faith, the Qadiyanis should not be worried”.

 

Justice Gull Muhammad

 “The Mirzais cannot express themselves as Muslims” or “The Mirzais cannot reveal Islam as their religion”

 

Mr. Amir ul Mulk Maingal (Baluchistan High Court)

    “After the whole discussion and arguments I have deduced that Article 298-b and 298-c of Pakistan Penal Code are two different crimes. The purpose of the article 298-b was that the names of the holy personalities, their epithets, and titles should be safeguarded from misuse. But the article 298-c declares that if any Qadiyani commits these things (of Article 298-B) he deserves punishment. When directly or indirectly any Qadiyani reveals himself as a Muslim or declares Islam as his faith or preaches his faith or provokes Muslim’s religious emotions anyway, he commits a crime.

 

Justice Muhammad Rafiq Tarrar

    “When the followers of Mirza Qadiyani use the words ‘Muhammad, the Prophet Of God ‘, they are blasphemous against Hazrat Muhammad (Sallallaho Alaihe Wassallam), the last Prophet of God”.

 

Justice Khaleel ur Rehman Ramday

    “According to a design, the Qadiyanis are disobeying the law by provoking Muslims’ religious emotions. According to the decisions of the Higher Courts, the appeal of a person who commits crime repeatedly can not be accepted”.

 

Justice Mian Nazeer Akhtar

    “To resemble Muslims, the Qadiyani or the Lahori followers of Mirza Qadiyani cannot use the signs of Islam. The Qadiyanis are a separate group and have nothing to do with the Muslim Ummah because Mirza Qadiyani openly disobeyed the Islamic teachings and falsely claimed of prophet hood and declared all those who did not have faith in his prophet hood as Kaafirs (infidels). He went to the extreme of declaring himself as Adam (Alaihe Salaam) , Mosses (Alaihe Salaam), Jesus Christ (Alaihe Salaam) and even Muhammad (Sallallaho Alaihe Wassallam) (God forgive).

    He dared to associate the verses of the Quran revealed to Muhammad (Sallallaho Alaihe Wassallam) with himself. For the Qadiyanis the word Muhammad (Sallallaho Alaihe Wassallam) in Kalema Tayyeba stands for Mirza Ghulam Ahmad Qadiyani. In the same manner, they invoke God’s blessings for Mirza Qadiyani. It means that when the Qadiyanis recite ‘Kalema Tayyeba ‘or invoke God’s blessings for Muhammad (Sallallaho Alaihe Wassallam), in fact they have Mirza Qadiyani in their mind and heart. And while doing so they are blasphemous against the Holy name of Hazrat Muhammad (Sallallaho Alaihe Wassallam).”

Justice Mian Mehboob Ahmad

    “To safeguard the seal of the Prophet Hood is the responsibility of the Muslim Ummah. With our pen, our practice, our tears, and our love, we are fulfilling our duty of safeguarding it. The beauty and prestige of the Muslim world depends on fulfilling this duty.

    Today there are number of mischievous rascals who are working against the concept of the seal of the prophet hood. Now it is the time to defend it boldly. I hope that Pakistan will be in the front line to get this honor. On the Day of Judgment when the Holy Prophet (Sallallaho Alaihe Wassallam) will ask about our role in the defense of his (Hazrat Muhammad (Sallallaho Alaihe Wassallam)   honor, the Pakistanis will offer proudly their words and blood as a gift. I pray God for your name and my name in the list of the lovers of the Holy Prophet (Sallallaho Alaihe Wassallam). This is a great blessing that we can beg from God and no doubt that God is the Hearer, the Wise.

Justice Kiyani

    Mirza Nasir, in a speech that he made in Rabwah, disclosed that there was no greenery in Rabwah. Qadiyanis dug 10 feet deep pits and filled them with soil brought from outside and succeeded in growing large trees. Justice Kiyani referred to Mirza Nasir’s speech and said:

    “You deserve to be praised. While you have successfully planted a false prophet in the hard and rocky ground of Khatm e Nubuwwat (the seal of prophet hood), growing a tree in the rocky land of Rabwah was not at all difficult for you.”

Justice Javed Iqbal 

    Referring to his father, Justice Javed Iqbal says:

    “For Iqbal the new revival of Zoroast (fire worshipping) of pre Islam era was brought up by two movements- the Behaiyat and the Qadiyaniat. In a sense, Behaiyat showed honesty by openly separating itself from Islam. However, Qadiyaniat is still sticking to Islam’s appearances and rituals while deviating from its spirit and mission. According to Iqbal (Rehmat-Ullah-Alleh) such terms as ‘Bruzi’, ‘Halool’ (penetration), and ‘Zill’ (shadow) were coined by the movements that deviated from the Islam in the Muslim Iran. Even the term” the Promised Christ “is not the creation of Muslim conscious. In the end he says that the best way for the rulers of India is to declare the Qadiyanis a separate religious sect.”
